Welcome to RoketViral (“RoketViral,” “we,” “our,” or “us”). By accessing or using the RoketViral mobile application, websites, APIs, and related services (collectively, the “Service”), you (“you,” “User”) agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
1. Description of the Service
RoketViral is an AI-powered creator tool that may provide:
- Viral probability predictions and scoring
- Video/content analytics and performance insights
- AI-generated feedback and improvement suggestions
- Posting/upload assistance and scheduling to supported social platforms
- Performance tracking and workflow features
RoketViral does not guarantee virality, accuracy, performance improvements, or any specific results. Outputs are informational and advisory only.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3. Accounts, Security, and Access
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity under your account
- Ensuring your device and account are secured
We may suspend or terminate access if we reasonably believe your account is compromised, being misused, or violating these Terms.
4. Social Media Integrations and Third-Party Platforms
4.1 Connecting Accounts
RoketViral may allow you to connect third-party social media accounts (e.g., YouTube and other supported platforms as they are added). Connections are granted via the platform’s official authorization flow (e.g., OAuth or similar).
4.2 Your Control and Revocation
You control connected accounts and may revoke access at any time by disconnecting in the Service (where available) and/or revoking access within the platform’s settings. After revocation, RoketViral can no longer access that account using that authorization.
4.3 Platform Rules
Your use of third-party platforms is governed by those platforms’ terms and policies. RoketViral is not responsible for platform actions such as removals, restrictions, demonetization, account flags, suspensions, or API limitations.
5. Third-Party AI Processing (Gemini / Vertex AI and OpenAI)
To provide analytics and AI-generated insights, RoketViral uses third-party AI systems, including Google (Vertex AI / Gemini) and OpenAI (ChatGPT).
By using AI features, you acknowledge and agree that:
- Your content (videos, captions, text, metadata) may be transmitted securely to these providers for processing.
- AI outputs may be inaccurate, incomplete, unreliable, or contain errors.
- RoketViral does not control third-party model internals and is not responsible for provider-side behaviors.
- RoketViral is not affiliated with or endorsed by Google or OpenAI.
- Your content is not used to train these providers’ models for this use case (per provider settings/commitments).
If you do not consent to third-party AI processing, do not use AI features or upload content for AI analysis.
6. User Content
6.1 Your Rights in Your Content
You retain ownership of content you upload or submit to the Service (“User Content”), subject to the license you grant below.
6.2 License You Grant to RoketViral
To operate the Service, you grant RoketViral a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, transmit, and display your User Content only as needed to:
- Provide analytics and AI processing you request
- Generate predictions, insights, and recommendations
- Enable scheduling/upload and publishing actions you initiate
- Maintain and improve Service functionality and security
This license ends when your User Content is deleted from our systems (subject to limited retention described in the Privacy Policy, backups, and legal/compliance needs).
6.3 Content You Publish to Platforms
If you publish content through the Service to a third-party platform, that platform may store and process it under its own policies. RoketViral is not responsible for third-party platform retention, sharing, or distribution once posted.
7. Acceptable Use and Prohibited Conduct
You agree not to use the Service to:
- Upload or distribute unlawful, exploitative, hateful, violent, or abusive content
- Infringe intellectual property, privacy, publicity, or other rights of others
- Harass, threaten, defame, or impersonate any person or entity
- Attempt to bypass security, access data not belonging to you, or probe/scan vulnerabilities
- Reverse engineer, extract source code, or misuse the Service or AI systems
- Automate usage in a way that materially strains or disrupts the Service
- Generate or promote deceptive or fraudulent activity (including spam or platform manipulation)
Violations may result in suspension or termination.
8. Predictions, Analytics, and No Guarantees
RoketViral may provide AI-generated outputs including:
- Viral probability scores and engagement predictions
- Trend/timing recommendations
- Caption/title/hashtag suggestions
- Content optimization insights
You acknowledge and agree that:
- Outputs are not guarantees of performance or results.
- You are solely responsible for how you use outputs and what you publish.
- RoketViral is not liable for your creator performance, business outcomes, or platform consequences.
9. Subscriptions, Billing, and Payments
9.1 Payment Processing
Subscriptions may be processed via Stripe or other authorized payment methods. Where applicable, you also agree to the payment processor’s terms and privacy policy.
If subscriptions are ever offered through the Apple App Store or Google Play Billing, those purchases will be governed by Apple/Google terms and managed through their account systems.
9.2 Subscription Terms
- Subscriptions automatically renew unless canceled before the renewal date.
- Canceling stops future renewals; access typically continues until the end of the current billing cycle.
9.3 Pricing and Changes
We may change pricing, plans, or features from time to time. If changes apply to an existing subscription, we will provide notice as required by law and/or the applicable platform/payment processor rules.
9.4 No Refunds (With Legal Exception)
All purchases and renewals are non-refundable, except where required by law or required by the applicable app marketplace/payment processor policies.
10. Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and retain information (including temporary video storage, analytics retention windows, and social platform data access).
11. Intellectual Property
11.1 Our IP
The Service (including software, designs, trademarks, logos, and proprietary scoring/analytics systems) is owned by RoketViral and/or its licensors and is protected by applicable intellectual property laws.
12. Termination
We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or create risk or legal exposure for RoketViral or others. You may stop using the Service at any time.
Termination may not automatically cancel an active subscription; you must cancel through your account billing method.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROKETVIRAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate or reliable.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROKETVIRAL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, FOLLOWERS, VIEWS, ENGAGEMENT, OR BUSINESS OPPORTUNITIES.
TO THE EXTENT PERMITTED BY LAW, ROKETVIRAL’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO ROKETVIRAL FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF NONE, $100).
(Some jurisdictions do not allow certain limitations; in those cases, limitations apply to the extent permitted.)
15. Indemnification
You agree to indemnify and hold harmless RoketViral from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.
16. Modifications to the Service or Terms
We may modify the Service and/or these Terms from time to time. If we make material changes, we will provide notice as required by law. Continued use after changes become effective constitutes acceptance.
17. Governing Law
These Terms are governed by the laws of the state/country of RoketViral’s registered business entity, without regard to conflict-of-law principles.
